SCO Squeaks By On Unix Appeal

Somehow, SCO just keeps on ticking. Critics will be glad to hear that the 10th Circuit Court of Appeals recently backed a decision that should have SCO paying Novell about $3 million, but unfortunately, a decision that Novell owns the Unix code was overturned at the same time.

This means that the question of Unix ownership might be decided by a jury trial. In that event, Novell explained in a blog post, "Novell intends to vigorously defend the case and the interests of its Linux customers and the greater open source community. We remain confident in the ultimate outcome of the dispute."

Still, even if SCO has miraculously managed to not stay down, it's important to remember that it isn't exactly a resource-rich entity. SCO has filed for bankruptcy, which means that it should have a lot of trouble keeping pace with a successful corporation like Novell.

Furthermore, considering that a trustee has been appointed to govern SCO's moves, SCO may not even get the chance to pursue this matter any more.

We'll see what happens. In the meantime, at least this story of SCO's almost inconceivable survival could inspire a good zombie screenplay or two.
